This Policy describes how content on the Bizzibo Platform is moderated, how complaints and takedown notices are handled, and the escalation, counter-notification and transparency commitments that apply.
INTRODUCTION
This Content Moderation Policy (“Policy”) describes how content on the Bizzibo platform (the “Platform”), operated by Bizzibo India Private Limited (“Bizzibo”, “we”, “us” or “our”), is moderated, how complaints and takedown notices are handled, and the rights you have to challenge content removal decisions.
This Policy is issued in compliance with the Information Technology Act, 2000 (“IT Act”), the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (“Intermediary Rules”), the Consumer Protection (E-Commerce) Rules, 2020 (“E-Commerce Rules”), and other applicable Indian law. It applies to all four Modules — the B2B Marketplace, the B2C Marketplace, the Service Marketplace and the Global Sourcing module — and to all content made available on the Platform, including Listings, User-Generated Content, profile information and communications routed through the Platform.
This Policy must be read together with the Terms of Use, the Privacy Policy and the Refund Policy. Capitalised terms used here have the meanings given in the Terms of Use unless separately defined below.
Three things to know up front. First, Bizzibo operates as an intermediary under Section 79 of the IT Act and discharges its statutory due-diligence obligations under the Intermediary Rules. We do not pre-screen or endorse third-party content as a matter of course; we moderate content reactively in response to complaints, automated signals and lawful directions, and proactively in respect of categories where the law or the trust-and-safety architecture so requires. Second, complaints and takedown notices follow a structured procedure with statutory timelines, and you have the right to challenge a content-removal decision through the counter-notification procedure described in Clause 7. Third, nothing in this Policy limits your rights under the Consumer Protection Act, 2019, the Digital Personal Data Protection Act, 2023, or any other Applicable Law.
1. SCOPE AND APPLICATION
1.1 What this Policy Covers
This Policy covers (a) the categories of content that are prohibited or restricted on the Platform; (b) how Bizzibo identifies, assesses and acts on content that may breach those categories; (c) how complaints and takedown notices are submitted, processed and resolved; (d) the timelines that apply, including statutory timelines under the Intermediary Rules and the IT Act; (e) the counter-notification procedure available where content is removed; (f) the consequences of repeated breach (including suspension or termination of accounts); (g) Bizzibo’s handling of requests from courts, regulators and law enforcement; and (h) Bizzibo’s annual transparency reporting commitment.
1.2 What this Policy Does Not Cover
This Policy does not cover (a) the contractual moderation obligations of Vendors, Service Providers and Global Sourcing Partners under their respective agreements with Bizzibo, save where they intersect with this Policy; (b) the moderation policies of third-party services, social media platforms or websites linked from the Platform; (c) the processing of Personal Data, which is governed by the Privacy Policy; and (d) cancellations, returns and refunds, which are governed by the Refund Policy.
1.3 Acceptance and Updates
By using the Platform, you agree to comply with this Policy. Bizzibo may amend this Policy from time to time. Where the changes are material and adverse to your interests, we will notify you through the Platform, by email or by other reasonable means at least fifteen (15) days before the changes take effect, save where shorter notice is required by Applicable Law or by a regulatory direction. Where the changes are not adverse to you, we will publish the updated Policy on the Platform with a revised effective date. The version of this Policy applicable to a particular item of content is the version in force at the time the content is hosted, displayed or otherwise made available.
2. DEFINITIONS
The defined terms in the Terms of Use apply to this Policy. The following additional terms are defined for the purposes of this Policy.
“Content” means any information, material, communication or expression hosted, displayed or otherwise made available on or through the Platform, including Listings, User-Generated Content, profile information, advertisements, communications routed through the Platform, and content uploaded in connection with grievances and complaints.

“Government Order” means a written order, notification, requisition or direction issued by a court of competent jurisdiction or by the Appropriate Government or its agency, in each case in accordance with Applicable Law.
“Intermediary Rules” means the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, as amended.

“Notifier” means the person submitting a Notice.
“Removal” means the removal of Content, the disabling of access to Content, the restriction of the distribution or visibility of Content, or any other action taken in respect of Content under this Policy. “Remove” and “Removed” have corresponding meanings.
“Reporter” means a Notifier.
3. CONTENT STANDARDS
3.1 Prohibited Content
Content of the following descriptions is prohibited on the Platform and is liable to Removal in accordance with this Policy. The categories below are read consistently with Rule 3(1)(b) of the Intermediary Rules and other Applicable Law, and reflect the same standards described in Clause 11.2 of the Terms of Use:
(a) Content that belongs to another person and to which the user does not have any right;
(b) Content that is obscene, pornographic, paedophilic, defamatory, libellous, invasive of another’s privacy (including bodily privacy), insulting or harassing on the basis of gender, racially or ethnically objectionable, relating or encouraging money laundering or gambling, or otherwise inconsistent with or contrary to Indian law;
(c) Content that is harmful to children;
(d) Content that infringes any patent, trade mark, copyright or other proprietary right;
(e) Content that violates any law for the time being in force;
(f) Content that deceives or misleads the addressee about the origin of a message or knowingly and intentionally communicates information which is patently false or misleading in nature, but may reasonably be perceived as a fact;
(g) Content that impersonates another person, including by way of artificially morphed or AI-generated images, audio or video;
(h) Content that threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order, or causes incitement to the commission of any cognisable offence, or prevents investigation of any offence, or is insulting to other nation;
(i) Content that contains software viruses or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource;
(j) Content that is patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity or agency for financial gain or to cause any injury to any person.
Without limiting the foregoing, Content that promotes or facilitates the sale of products or services prohibited under Schedule B to the Vendor Agreement (the Prohibited Products list), or that violates any category-specific restriction applicable to the Service Marketplace, or that is sold or offered in breach of Applicable Law in respect of the relevant category (food, drugs, medical devices, financial services, telecommunications, weapons, etc.), is also prohibited.
3.2 Restricted Content
Some Content categories are not prohibited but are restricted: they may be hosted on the Platform only with appropriate disclosures, age gates, geographic restrictions, content warnings or other safeguards, as required by Applicable Law and as configured by Bizzibo. Examples include: (a) age-restricted goods (such as alcohol-related accessories or tobacco-related accessories, where lawful for sale), which require age-gating where so required; (b) goods or services that require regulatory disclosures under their sectoral law (such as cosmetics, ayurveda, food supplements); (c) Listings that include user-generated images of identifiable persons, where appropriate consent flows must be respected; and (d) such other categories as Bizzibo may notify from time to time.
3.3 Module-Specific Standards
Each Module is subject to additional standards reflecting its commercial architecture: (a) the goods Modules require accurate Listing descriptions, statutory disclosures (under the Legal Metrology Act, 2009, the Food Safety and Standards Act, 2006, the Drugs and Cosmetics Act, 1940 and the Bureau of Indian Standards Act, 2016, as applicable), country-of-origin labelling, and accurate pricing and availability information, in each case in accordance with the Vendor Agreement and Schedule G; (b) the Service Marketplace requires accurate qualification, experience and pricing information from Service Providers, and prohibits Listings in categories deferred to Phase 2 (legal, medical, chartered accountancy, company secretarial, architecture, registered valuer services); and (c) User-Generated Content (reviews and ratings) must reflect genuine experience and must not be paid, induced, fabricated, or part of coordinated inauthentic behaviour. Breach of these module-specific standards is treated, for the purposes of this Policy, as a breach of Clause 3.1(e) (violation of Applicable Law) and the Vendor / Service Provider / Global Sourcing Partner agreement.
4. HOW WE MODERATE
4.1 Reactive Moderation
Bizzibo’s primary moderation channel is reactive: we act on Content in response to complaints, takedown notices, Government Orders, and signals raised through automated detection. The combination of user reports, partner reports (from Vendors, Service Providers, Global Sourcing Partners and trusted third parties), and operational signals provides the principal basis for our moderation decisions.
4.2 Proactive Moderation
Bizzibo also undertakes proactive moderation in specific categories where the law, trust and safety considerations, or operational risks so require. These include (a) onboarding due diligence on Vendors, Service Providers and Global Sourcing Partners; (b) automated detection of suspected fraud, account takeover, manipulation of ratings, and coordinated inauthentic behaviour; (c) periodic review of categories at high risk of regulatory non-compliance (regulated medical, food and consumer goods); (d) review of Listings flagged by automated systems for anomalous attributes (price, location, image fingerprint); and (e) ad hoc review where significant risks are identified through internal trust and safety processes.
4.3 Use of Automated Tools
Bizzibo uses automated tools (including text classification, image hashing, fraud signals and anomaly detection) to assist in identifying Content that may require human review. Automated tools may surface Content for review and, in narrowly defined cases (such as known illegal content matched by hash, or repeat infringements by a previously suspended account), may apply Removal automatically subject to subsequent human review on appeal. Where automated tools are used, the principles described in Clause 4.4 apply to the human review.
4.4 Human Review
Final decisions on contested Content, on Counter-Notifications, and on Removals attracting significant consequences (such as account suspension or termination) are taken by trained human reviewers. Reviewers apply this Policy and Applicable Law, consult with the Grievance Officer where appropriate, and document the basis for the decision.
4.5 Editorial Discretion
Bizzibo retains editorial discretion to determine the categorisation, search ranking, prominence and display of Content on the Platform, on the basis of objective, non-discriminatory criteria as described in Clause 5.4 of the Terms of Use. Decisions made under this Clause 4.5 are not Removals and are not subject to the Counter-Notification procedure in Clause 7.
5. REPORTING CONTENT
5.1 Who Can Report
Any person may submit a Notice in respect of Content on the Platform, including (a) any user of the Platform; (b) any person whose rights are affected by the Content (including persons claiming intellectual property infringement, persons whose Personal Data has been disclosed without authorisation, persons depicted in the Content without consent, and persons defamed by the Content); (c) any Vendor, Service Provider or Global Sourcing Partner; (d) any government or regulatory authority; and (e) any other person with a legitimate interest in the Content.
5.2 How to Report
Notices may be submitted through (a) the in-product reporting tools available on the Platform, which are the recommended channel for most Notices; (b) email to the Grievance Officer at the address in Clause 13; (c) postal communication to our registered office, marked for the attention of the Grievance Officer; or (d) the dedicated channels for specific Notice types described in Clause 5.4.
5.3 What to Include in a Notice
A Notice should include (a) the Notifier’s name, address and contact details (email and telephone); (b) the URL or other identifier of the Content (or, where the Content is not URL-addressable, sufficient information to enable identification); (c) the nature of the complaint, including the category of Content under Clause 3 alleged to be breached, with reference to the specific provision of this Policy or Applicable Law; (d) a statement of the resolution sought (Removal, restriction, modification or other action); (e) any supporting documents, evidence or links; (f) where the Notice is submitted on behalf of another person (for example, by an authorised representative or legal counsel), confirmation of authority and contact details for the underlying complainant; and (g) a statement that the information provided is true and accurate to the best of the Notifier’s knowledge.
Where a Notice is incomplete or insufficiently specific, Bizzibo may revert to the Notifier requesting additional information. The acknowledgment timeline in Clause 6.1 begins on receipt of a Notice; where additional information is required, the resolution timeline runs from receipt of the additional information.
5.4 Specialised Notice Forms
Specific categories of Notice have specialised forms or content requirements:
(a) Intellectual property infringement. A Notice alleging infringement of patent, trade mark, copyright or other intellectual property right should include details of the right asserted (including registration details where applicable), evidence of ownership or authorisation to act, identification of the allegedly infringing Content, and a statement that the Notifier has a good-faith belief that the use is unauthorised.
(b) Section 67 / 67A IT Act Content. A Notice alleging that Content violates Section 67 or Section 67A of the IT Act (publishing or transmitting obscene material, or material containing sexually explicit acts in electronic form) is treated under the urgent timelines in Clause 6.2.
(c) Non-consensual intimate imagery and impersonation. A Notice alleging that Content exposes the private area of an individual, shows an individual in full or partial nudity, or shows or depicts an individual in any sexual act or conduct, or is in the nature of impersonation in an electronic form (including artificially morphed or AI-generated images, audio or video), is treated under the urgent timelines in Clause 6.2.
(d) Defamation. A Notice alleging defamation should specify the words or images alleged to be defamatory, the harm caused or anticipated, and (where applicable) the relationship between the Content and the underlying Listing or Transaction. Where the alleged defamation is contained in a User-Generated review or rating, Clause 8.4 applies.
(e) Personal Data. A Notice relating to Personal Data of the Notifier, including a request for Removal of Content under the right to erasure under the DPDP Act, is treated as a Data Principal request under Clause 10 of the Privacy Policy and is referred to the Data Protection Officer for primary handling, with coordination with the Grievance Officer where Content removal is involved.
(f) Hate speech, harassment and threats. A Notice alleging hate speech, harassment, threats or other Content prohibited under Clause 3.1(b) or 3.1(h) should specify the targeted person or community, the nature of the harm, and the context. Such Notices are treated with priority.
(g) Government Orders. A Government Order issued by a court of competent jurisdiction, or by the Appropriate Government or its agency, is treated under the timelines in Clause 6.3.
5.5 Confidentiality of Reporters
Bizzibo treats the identity of a Notifier as confidential to the extent reasonably practicable, save where (a) disclosure is required under Applicable Law; (b) disclosure is necessary to enable the affected user to defend against the Notice; (c) the Notifier is, by Applicable Law, required to be identified to the affected user (for example, in some intellectual property processes); or (d) the Notifier consents to disclosure.
5.6 Bad-Faith Notices
Notices submitted in bad faith — including with intent to harass another user, to suppress legitimate Content, to gain commercial advantage through targeted Removal of competitor Listings, or to circumvent the Vendor Agreement or the Service Provider Agreement — may attract action against the Notifier under the Terms of Use, including warnings, account suspension and account termination. Where a Notice is identified as bad-faith, Bizzibo may decline to act on it, may notify the affected user, and may include the matter in the transparency reporting under Clause 10.
6. TAKEDOWN TIMELINES AND PROCESS
6.1 Acknowledgment
Bizzibo will acknowledge receipt of every Notice within twenty-four (24) hours of receipt, in accordance with Rule 3(2)(a) of the Intermediary Rules. The acknowledgment will include a reference number, an outline of the next steps, and an estimated resolution timeline.
6.2 Urgent Categories — 24 Hours
Bizzibo will act upon a valid Notice in respect of Content described in this Clause 6.2 within twenty-four (24) hours of receipt of the Notice, in accordance with Rule 3(2)(b) of the Intermediary Rules and the IT Act:
(a) Content that exposes the private area of an individual, shows an individual in full or partial nudity, or shows or depicts an individual in any sexual act or conduct;
(b) Content that is in the nature of impersonation in an electronic form, including artificially morphed or AI-generated images, audio or video;
(c) Content that violates Section 67 or Section 67A of the IT Act (publishing or transmitting obscene material, or material containing sexually explicit acts, in electronic form); and
(d) Content involving the sexual exploitation of children, in respect of which Bizzibo will act with the highest urgency, will preserve evidence as required under the IT Act and the Protection of Children from Sexual Offences Act, 2012, and will report to the appropriate authority.
6.3 Cooperation with Authorities
(a) Government Orders — 36 Hours. On receipt of a Government Order, Bizzibo will Remove or disable access to the Content identified in the Government Order within thirty-six (36) hours of receipt, in accordance with Rule 3(1)(d) of the Intermediary Rules. Where the Government Order is unclear, requires authentication, or appears not to comply with the requirements of Applicable Law, Bizzibo may seek clarification before acting; the timeline runs from receipt of a clear and verified Government Order.
(b) Information Requests — 72 Hours. Where Bizzibo receives a lawful order or request for information from an authorised government agency under Rule 3(1)(j) of the Intermediary Rules, Section 94 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (or its predecessor, Section 91 of the Code of Criminal Procedure, 1973, where applicable), or any other Applicable Law (an "Information Request"), Bizzibo will provide the information requested, or assistance in respect of the matter requested, within seventy-two (72) hours of receipt of the Information Request, in accordance with Rule 3(1)(j) of the Intermediary Rules, or within such shorter period as may be specified in the Information Request or required by Applicable Law.
The information that Bizzibo may be required to disclose under this Clause 6.3(b) includes, without limitation, account registration details, transaction records, communication metadata, device and access logs, and other records held by Bizzibo in the ordinary course of business. Where the Information Request is unclear, requires authentication, or appears not to comply with the requirements of Applicable Law, Bizzibo may seek clarification before responding; the timeline runs from receipt of a clear and verified Information Request. Where the information requested constitutes Personal Data (as defined under the Digital Personal Data Protection Act, 2023), the disclosure is governed additionally by the Privacy Policy.
Information Requests are received by the Nodal Person of Contact designated by Bizzibo in compliance with Rule 4(3) of the Consumer Protection (E-Commerce) Rules, 2020 and Rule 3(2) of the Intermediary Rules, whose details are published on the Platform.
6.4 Intellectual Property Notices
Notices alleging intellectual property infringement are typically resolved within seven (7) days of receipt of a complete Notice, save in cases of clear infringement where action may be taken sooner. Where the Notice is contested by the affected user through Counter-Notification under Clause 7, Bizzibo may either retain the Removal pending resolution of the dispute, or restore the Content pending resolution, depending on the strength of the prima facie case and the nature of the alleged infringement.
6.5 General Grievances — 15 Days
All other Notices are resolved within fifteen (15) days of receipt of a complete Notice, in accordance with Rule 3(2)(a) of the Intermediary Rules. Where a Notice cannot reasonably be resolved within fifteen (15) days (for example, because of the complexity of the matter or the need to obtain information from third parties), Bizzibo will inform the Notifier of the reasons and provide an estimated revised timeline.
6.6 Process and Decision
On receipt of a Notice, Bizzibo will (a) assess the Notice against this Policy and Applicable Law; (b) where appropriate, share relevant elements of the Notice with the affected user (the user who posted the Content), with reasonable opportunity to respond before Removal, save where prior notification is impracticable, prejudicial to investigation, or prohibited by Applicable Law (including in respect of urgent categories under Clause 6.2 and Government Orders under Clause 6.3); (c) make a decision — to Remove, to retain, to modify, to restrict distribution, to apply a label or warning, or to take other action — documented with reasons; (d) notify the Notifier and (where appropriate and permissible under Applicable Law) the affected user of the decision; and (e) where Removal is effected, notify the affected user of the right to submit a Counter-Notification under Clause 7.
6.7 Statutory and Regulatory Override
The timelines in this Clause 6 operate without prejudice to (a) any shorter timeline that may be required under Applicable Law or under a specific Government Order; (b) any direction issued by a court, regulator or competent authority requiring Removal or other action; and (c) any obligation of Bizzibo to preserve evidence in respect of Content while complying with a Removal direction.
7. COUNTER-NOTIFICATION
7.1 Right to Counter-Notify
Where Content is Removed under this Policy and the affected user disagrees with the Removal, the affected user has the right to submit a Counter-Notification challenging the Removal. The Counter-Notification procedure is a structured mechanism that operates in addition to (and not in derogation of) any statutory right of appeal, judicial review or grievance redressal available to the affected user.
7.2 Time Limit for Submission
A Counter-Notification must be submitted within seven (7) days of the affected user receiving notice of the Removal, save where Bizzibo, in its discretion and on a written request from the affected user setting out reasonable grounds, extends the period. The seven-day period is sufficient for the affected user to seek legal advice and to assemble supporting material; longer periods compromise the practical effectiveness of reinstatement.
7.3 Content of a Counter-Notification
A Counter-Notification should include (a) the affected user’s name, address and contact details; (b) identification of the Content that has been Removed and the date of the Removal; (c) a statement of the grounds on which the affected user contends that the Removal was incorrect, including (where applicable) reference to the specific category of Clause 3 alleged to have been incorrectly applied or to the legal basis on which the Content is asserted to be lawful; (d) any supporting documents, evidence, authorisations or proofs; (e) a statement that the affected user submits to the jurisdiction of the courts at Kochi (or such other forum as is competent under Applicable Law) for the purposes of any proceedings arising from the Counter-Notification; and (f) a statement that the information provided is true and accurate to the best of the affected user’s knowledge.
7.4 Decision Timeline
Bizzibo will decide a Counter-Notification within seven (7) days of receipt of a complete Counter-Notification, save where (a) the matter requires consultation with the original Notifier and the original Notifier requires additional time to respond; (b) the matter requires legal advice or input from the Grievance Officer or the Nodal Officer; or (c) the underlying Notice is the subject of a Government Order or pending judicial proceedings, in which case the Counter-Notification will be held in abeyance pending the outcome of those proceedings. Where the seven-day timeline cannot be met, Bizzibo will notify the affected user of the reasons and provide an estimated revised timeline.
7.5 Outcomes
Bizzibo may, on a Counter-Notification, (a) reinstate the Content in full; (b) reinstate the Content with modifications, labels, warnings, or other restrictions; (c) maintain the Removal, with reasons; or (d) refer the matter for further assessment under Clause 6.6 with a revised timeline. Where the Content is reinstated, Bizzibo will notify the original Notifier and (where appropriate) provide the original Notifier with a reasonable opportunity to pursue further remedies through the courts or competent authorities.
7.6 Where the Original Notifier Disputes Reinstatement
Where the original Notifier obtains a Government Order or other competent legal direction requiring Removal, Bizzibo will give effect to such Order within the applicable timeline. Pending such Order, the Counter-Notification decision under Clause 7.5 stands.
7.7 Counter-Notification Not Available in Specific Cases
The Counter-Notification procedure under this Clause 7 is not available in respect of (a) Removals effected pursuant to a Government Order, in which case the affected user’s remedies lie before the relevant court or authority that issued the Order; (b) Removals of Content involving the sexual exploitation of children, where reinstatement would be contrary to Applicable Law; (c) Removals required to give effect to interim relief granted by a court; and (d) Removals that, in Bizzibo’s reasonable assessment after human review, present a continuing risk to user safety, public order or platform integrity.
8. REPEAT OFFENDER AND ESCALATION
8.1 Progressive Consequences
Bizzibo applies progressive consequences for breaches of this Policy and the Terms of Use, calibrated to severity, frequency, category, intent, harm caused and remediation. Consequences may include (a) warning notices; (b) Removal of specific Content; (c) restrictions on the visibility or distribution of Content; (d) suspension of specific Listings or features; (e) suspension of accounts (Customer, Vendor, Service Provider or Global Sourcing Partner) for defined periods; (f) termination of accounts; and (g) referral to law enforcement where the conduct may constitute a criminal offence.
8.2 Factors Considered
In determining the appropriate consequence, Bizzibo considers (a) the category of the breach (with serious categories under Clauses 3.1(b), 3.1(c), 3.1(g) and 3.1(h) attracting heavier consequences); (b) the frequency of breaches by the same user; (c) whether prior warnings or sanctions have been issued; (d) the actual or potential harm caused, including reputational, financial, physical or psychological harm; (e) the apparent intent of the user; (f) the user’s response to the breach (whether the user has cooperated, removed the Content voluntarily, or made amends); (g) the impact on Vendors, Service Providers, Global Sourcing Partners or other users; and (h) any directions from regulators or law enforcement.
8.3 Categories Requiring Escalated Treatment
Certain breaches receive escalated treatment from the outset, regardless of frequency. These include (a) Content involving the sexual exploitation of children, which attracts immediate Removal, evidence preservation and reporting to authorities; (b) Content threatening the safety, security or sovereignty of India, which attracts immediate Removal and reporting to authorities; (c) Content involving non-consensual intimate imagery or impersonation under Clause 6.2(a) or 6.2(b), which attracts immediate Removal and may attract account suspension; (d) repeated and apparent intentional intellectual property infringement; and (e) coordinated inauthentic behaviour, including paid review networks, fake account networks and fraud rings.
8.4 Reviews and Ratings
User-Generated reviews and ratings present specific moderation considerations because (a) genuine negative reviews are a legitimate exercise of consumer expression and are typically not Removed at the request of the reviewed Vendor or Service Provider; (b) defamatory, false or paid reviews are prohibited under Clause 3 and are Removed; and (c) coordinated review-manipulation campaigns (whether positive or negative) are prohibited and may attract action against the accounts involved. The standard for Removing a review is the standard for Removing any Content under Clauses 3 and 6, applied with sensitivity to the legitimate role of consumer expression.
9. GOVERNMENT ORDERS AND LAW ENFORCEMENT REQUESTS
9.1 Compliance with Lawful Requests
Bizzibo complies with Government Orders and lawful requests from law enforcement agencies, courts, regulators and other competent authorities, in accordance with the IT Act, the Intermediary Rules, the Code of Criminal Procedure, 1973 (or its successor legislation), the DPDP Act and other Applicable Law. Compliance includes (a) Removal of Content as required under Clause 6.3; (b) preservation of evidence as required under the IT Act and the Indian Evidence Act, 1872; (c) provision of information about a user, account or transaction in response to a lawful request; and (d) such other actions as may be required under Applicable Law.
9.2 Nodal Officer
Bizzibo has designated a Nodal Officer for coordination with law enforcement agencies, in accordance with the Intermediary Rules. The Nodal Officer is the first point of contact for law enforcement requests and works with the Grievance Officer, the Data Protection Officer and external counsel to ensure that requests are addressed lawfully and efficiently.
9.3 Notice to Affected Users
Where Content is Removed, or Personal Data of a user is disclosed, in response to a Government Order or law enforcement request, Bizzibo will, where reasonably practicable and not prohibited by Applicable Law or by the terms of the Order, notify the affected user of the action taken. Where notification is prohibited or restricted (for example, under a non-disclosure direction issued in connection with an ongoing investigation), Bizzibo will refrain from notifying for the relevant period and will document the basis for the restriction.
9.4 Records
Bizzibo maintains records of Government Orders, law enforcement requests, the actions taken in response, and the basis for any restriction on user notification. These records are retained for the periods required under Applicable Law and the Privacy Policy, and may be reviewed for the purposes of internal audit and the transparency reporting under Clause 10.
10. TRANSPARENCY REPORTING
10.1 Annual Transparency Report
Bizzibo will publish an annual transparency report on the Platform, covering each financial year. The first annual transparency report will be published within a reasonable period after the end of the first full financial year following the Effective Date of this Policy. Subsequent reports will be published within a reasonable period after the end of each subsequent financial year.
10.2 Contents of the Transparency Report
Each annual transparency report will include, to the extent reasonably practicable and consistent with Applicable Law: (a) the volume of Notices received, broken down by category (Clause 3 categories, Government Orders, intellectual property notices, etc.); (b) the volume of Removals effected, broken down by category and by Module; (c) the volume of Counter-Notifications received and the outcomes; (d) the volume of Government Orders and law enforcement requests received and complied with, broken down by type of authority and (where lawful to disclose) by jurisdiction; (e) the volume of Personal Data Breach notifications made to the Data Protection Board under the DPDP Act, where applicable; (f) the volume of accounts suspended or terminated under Clause 8, broken down by user category; and (g) any aggregate trend information that Bizzibo considers material to user understanding of moderation outcomes on the Platform.
10.3 Limitations on the Transparency Report
The transparency report will not include information that, if disclosed, would (a) compromise an ongoing investigation or law enforcement operation; (b) breach a non-disclosure direction issued under Applicable Law; (c) disclose Personal Data of an identifiable user; (d) compromise the security or operational integrity of the Platform; or (e) be commercially sensitive in a manner that materially harms Bizzibo or its counterparties. Where information is excluded for any of these reasons, the report will say so at a category level.
10.4 Format and Accessibility
The transparency report will be published on the Platform in a manner that is reasonably accessible, including a downloadable summary in widely used formats. Earlier reports will remain available on the Platform or on request from the Grievance Officer.
11. STATUTORY RIGHTS PRESERVED
Nothing in this Policy forecloses, limits or in any way reduces (a) any right or remedy you have under the Consumer Protection Act, 2019 or any other consumer protection law of India that is not capable of being limited or excluded by contract; (b) any right of grievance redressal you have under the DPDP Act, including the right to approach the Data Protection Board; (c) any right to approach a court, tribunal, regulator or other competent forum exercising jurisdiction conferred by statute; (d) any right to seek interim or final relief from a court of competent jurisdiction; or (e) any right of appeal that may be available against a moderation decision under Applicable Law.
The internal procedures described in this Policy — including the Notice procedure in Clause 5, the takedown timelines in Clause 6, the Counter-Notification procedure in Clause 7, and the consequences and escalation in Clause 8 — are first-line internal procedures designed to enable prompt and structured resolution. They are not, and are not intended to be, exclusive or final, and do not displace any statutory right of any person.
12. DESIGNATED OFFICERS
12.1 Grievance Officer
Bizzibo has designated a Grievance Officer in accordance with Rule 3(2) of the Intermediary Rules and Rule 4(5) of the E-Commerce Rules. The Grievance Officer is the principal point of contact for Notices under this Policy, for Counter-Notifications, and for grievances arising from moderation decisions. The Grievance Officer’s contact details are set out in Clause 13.
12.2 Nodal Officer
Bizzibo has designated a Nodal Officer for coordination with law enforcement agencies, as described in Clause 9.2. The Nodal Officer’s contact details are set out in Clause 13.
12.3 Data Protection Officer
For matters relating to Personal Data, including the right to erasure under the DPDP Act and breach notifications, the Data Protection Officer is the principal point of contact, as described in the Privacy Policy. Where a Notice involves both Content moderation and Personal Data, the Grievance Officer and the Data Protection Officer coordinate.
12.4 Coordination
Where a Notice or other matter spans multiple officer designations, Bizzibo will internally route the matter to the appropriate officer. A Notice received at the wrong officer’s designated address will not be rejected on that basis; it will be forwarded internally and the Notifier will be informed of the routing.
13. UPDATES AND CONTACT
13.1 Updates
